Technical platform and hosting

The WeAreCOM.club member area is deployed using the inwink solution, published by inwink, a French simplified joint-stock company with share capital of 111,100 euros, registered with the Paris Trade and Companies Register under number 521 915 637, with its registered office at 33 rue du Faubourg Saint-Antoine, 75011 Paris, France.

Hosting of the solution is provided by Microsoft Ireland Operations, through its Azure cloud services offering, with its registered office at One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland.

Platform data is hosted in European data centres located in Dublin (Ireland) and Amsterdam (Netherlands).

Please note: the WeAreCOM.fr media site, which is separate from the member area, is hosted by Kinsta Inc., 8605 Santa Monica Blvd #92581, West Hollywood, CA 90069, United States.

Access to the member area

Access to WeAreCOM.club is reserved for individuals holding a valid We Are COM Club membership, whether individual or subscribed to by their organisation, as well as for guests and speakers expressly authorised by We Are COM SAS.

Each member is issued personal login credentials, which are strictly confidential and non-transferable. Members are solely responsible for any use made of their account and undertake not to share their credentials with any third party, including within their own organisation. Any shared use, unauthorised access or attempted unauthorised access may result in immediate suspension of the account, without notice or compensation.

We Are COM SAS reserves the right to suspend or delete an account in the event of a breach of this legal notice or of the Club membership terms, or upon expiry of the member's membership.

Liability

We Are COM SAS, together with its service providers and licensees, undertakes to use its best efforts to keep the member area accessible at all times. However, the company cannot be held liable for any unavailability of the platform, for any reason whatsoever, including interruptions relating to maintenance, updates to the inwink solution, a failure on the part of the host, or any disruption of the Internet network.

Members acknowledge that they have read this legal notice and undertake to comply with it. They acknowledge that they have the skills and resources required to access and use the platform, and that they have verified that the computer configuration used contains no viruses and is in perfect working order.

The content made available in the member area, including session recaps, replays, studies, materials and resources, is provided for information purposes. Use of the information it contains is the sole responsibility of the member. We Are COM SAS cannot under any circumstances be held liable for the consequences of such use, nor for any error or omission.

Member-generated content

The member area includes features allowing members to complete a profile, interact with one another and, where applicable, publish content or comments.

Each member remains responsible for the content they publish. Members warrant that they hold the rights and authorisations required to publish such content, and undertake to ensure that it does not infringe third-party intellectual property rights, image rights relating to property or persons, privacy, public order or public decency. Exchanges must respect the standards of courtesy and collegiality that characterise the community.

We Are COM SAS reserves the right to moderate, block or remove any content that breaches these principles, without notice.

Discussions held during Club sessions and content shared in the member area are reserved for use within the community. Members undertake not to circulate them externally without the prior consent of We Are COM SAS and, where applicable, of the author.

Intellectual property

The overall structure and the components of the WeAreCOM.club member area are the exclusive property of We Are COM SAS, with the exception of the components of the inwink solution, which remain the exclusive property of inwink.

The logos and trademarks of companies mentioned on WeAreCOM.club are the exclusive property of their respective owners. Any representation, reproduction or exploitation, whether partial or total, of these trademarks is prohibited without the prior written consent of their owners.

Copyright

Any total or partial reproduction of the member area, its content, replays, session materials, studies and resources, by any person and without the express authorisation of We Are COM SAS, is prohibited and would constitute an infringement punishable under Articles L. 335-2 et seq. of the French Intellectual Property Code.

Access to member area content is granted to members for their own personal and professional use only. Prohibited uses include, in particular, downloading for the purpose of redistribution, publication on an intranet or shared workspace, reproduction in any internal or external material, and any communication to non-member third parties.

Session recordings

We Are COM Club sessions, including webinars, conferences and meet-ups, may be recorded so that they can be made available as replays in the member area. Participants are informed of this before each session and may turn off their camera and microphone. Any request relating to the broadcasting of a participant's image or voice may be sent to contact@wearecom.fr.

Processing of personal data

In connection with the member area, We Are COM SAS acts as data controller. inwink acts as data processor within the meaning of Article 4 of Regulation (EU) 2016/679 (GDPR) and processes data on behalf of and under the instructions of We Are COM SAS.

Data collected. The data collected includes identification and contact details (surname, first name, professional e-mail address, professional telephone number), professional information (organisation, job title, sector, areas of interest, areas of expertise) and connection and usage data relating to the platform (session registrations, attendance, content viewed).

Purposes. This data is processed in order to manage memberships and access to the member area, organise sessions and handle registrations, enable members to connect with one another, send communications relating to Club activities, measure platform usage and improve the services offered.

Legal bases. Depending on the processing concerned: performance of the membership contract, the legitimate interest of We Are COM SAS in running its community, the member's consent for certain communications, and compliance with the company's legal obligations.

Retention period. Data is retained for the duration of the membership, then for a maximum of thirty-six (36) months from the last contact, without prejudice to the retention periods imposed by applicable legal and accounting obligations.

Location. Data is hosted within the European Union, in the Dublin and Amsterdam data centres.

Visibility between members. Certain profile information, in particular surname, first name, organisation and job title, may be visible to other Club members through the directory and networking features. Each member can edit their profile and visibility settings from their account.

Your rights. In accordance with the French Data Protection Act of 6 January 1978 as amended and with the General Data Protection Regulation, you have the right to access, rectify, erase, restrict, object to and port the information concerning you, as well as the right to issue instructions regarding the fate of your data after your death. To exercise your rights, please send an e-mail to contact@wearecom.fr. A copy of a signed identity document may be requested where there is reasonable doubt as to your identity.

If you consider that the processing of your data does not comply with the GDPR, you may lodge a complaint with the French data protection authority: Commission Nationale de l'Informatique et des Libertés, 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France.

Communications and newsletters

By joining the We Are COM Club, members agree to receive communications relating to community activities, including session invitations, reminders and practical information. These messages form part of the performance of the membership contract.

Members may also subscribe to the We Are COM editorial newsletters. They can unsubscribe at any time by clicking the unsubscribe link included in every e-mail, or from their account settings.

Cookies

The member area uses cookies that are necessary for its operation, in particular to maintain the login session, secure account access and remember display preferences. These cookies cannot be disabled without impairing the functioning of the platform.

Other cookies, intended for audience measurement and service improvement, are only placed with your consent, obtained via the banner displayed on your first connection. You can change your choices at any time using the cookie management link available on the platform.

You can also configure your browser to block or delete cookies already placed. The procedure varies depending on the browser used and is described in its help section, under headings such as "Privacy", "Privacy and security" or "Internet options". Refusing strictly necessary cookies will prevent access to the member area.

Governing law

This legal notice is governed by French law. In the event of a dispute concerning its interpretation or application, and failing an amicable settlement, jurisdiction is granted to the competent courts of Paris.

Language

This document is an English translation provided for convenience. In the event of any discrepancy between this version and the French version, the French version shall prevail.
